These Terms and Conditions ("Terms") govern your use of the Sporting Allstars mobile application ("App") provided by Sporting Allstars Limited ("we", "us", or "our"), a company registered in England and Wales with its registered office at 56 Onslow Gardens, Wallington, England, SM6 9QQ.
By downloading, installing, or using the App, you confirm that you are at least 16 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you must not use the App.
Definitions
"App" means the Sporting Allstars mobile application available on Apple App Store and Google Play.
"User", "you", or "your" means any individual who accesses or uses the App.
"Content" means any text, images, video, data, results, or other material available through the App.
"Health Data" means any information relating to your physical health or fitness, including height, weight, gender, location, and fitness metrics collected through the App.
"In-App Purchases" means digital content, features, or subscriptions purchased through Apple App Store or Google Play billing.
"Offline Components" means physical or non-digital services purchased through the App, including team memberships, club memberships, and related sporting products processed via Stripe.
"Services" means all features, functionality, content, and purchasing options provided through the App.
Eligibility & Age Requirement
You must be at least 16 years of age to use this App. By using the App, you confirm that you are 16 or older. If we discover that a user is under 16, we will immediately suspend their account and delete their data.
You must be at least 18 years of age to make any purchase through the App, whether In-App Purchases or Offline Component purchases. If you are aged 16 or 17, you may use the App's free features but may not make any purchases.
By using the App, you also confirm that you are not barred from receiving services under the laws of the United Kingdom or any other applicable jurisdiction.
Account Registration
To access certain features you must register an account. You may register using an email address and password, or via a supported social login provider (Apple, Google, or Facebook). By using social login, you authorise us to access and use certain information from that provider in accordance with our Privacy Policy.
When registering, you agree to:
- Provide accurate, current, and complete information, including your true date of birth;
- Keep your account credentials confidential and not share them with others;
- Notify us immediately at contact@sportingallstars.com if you suspect any unauthorised access to your account;
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts where information is found to be inaccurate, including misrepresentation of age.
Health & Fitness Data
The App collects and processes Health Data including your height, weight, gender, location, and fitness metrics. This data is classified as sensitive personal data under UK GDPR. By using the App's health and fitness features, you provide your explicit consent to this processing.
You may withdraw consent for health data processing at any time through the App's settings. Withdrawal will disable health and fitness features but will not affect your basic App access.
Important: The App does not constitute medical advice. Information and insights provided are for general fitness and sporting purposes only. You should consult a qualified medical professional before beginning any new exercise programme, particularly if you have any pre-existing health conditions.
Participation in sporting activities carries inherent physical risks. You participate in any activities connected to or inspired by the App entirely at your own risk. We accept no liability for any injury, illness, or harm arising from such participation.
Purchases & Payments
The App offers two types of purchasing. You must be at least 18 years of age to make any purchase.
In-App Purchases (Digital)
Certain digital features, content, or subscriptions may be purchased through Apple App Store or Google Play in-app billing. These purchases are subject to Apple's and Google's respective payment terms and refund policies. We do not directly handle payment card data for In-App Purchases.
Offline Component Purchases (Team & Club Memberships)
Purchases of Offline Components — including team memberships, club memberships, and other physical or non-digital sporting services — are processed through Stripe, a third-party payment processor. By making an Offline Component purchase, you agree to Stripe's terms of service and privacy policy.
- Payment card data is collected and processed directly by Stripe. We do not store your full card details;
- You must be at least 18 years of age to make a purchase;
- Prices are displayed in GBP and include applicable VAT where required by law;
- A confirmation will be sent to your registered email address following a successful transaction;
- Membership terms, including duration, renewal, and cancellation conditions, will be set out at the point of purchase and in your confirmation email.
Refunds — Offline Component Purchases
Team and club membership purchases are transactions between you and the relevant club or organisation ("the Club"). Sporting Allstars Limited acts as a payment facilitator for these transactions via Stripe Connect; we are not the merchant of record and the contract for membership is between you and the Club.
Refund requests for Offline Component purchases must be directed to the Club from which you purchased the membership. Contact details for the Club will be set out in your purchase confirmation email.
Where you are unable to obtain a satisfactory resolution from the Club, you may contact us at contact@sportingallstars.com and we will use reasonable endeavours to assist in resolving the matter, though we accept no liability for refunds in respect of transactions where the Club is the merchant of record.
Your statutory rights under the Consumer Contracts Regulations 2013 and Consumer Rights Act 2015 are not affected. Refunds for In-App Purchases are governed by Apple App Store or Google Play refund policies.
Licence to Use the App
Subject to these Terms, Sporting Allstars Limited grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device that you own or control, solely for your personal, non-commercial purposes.
You must not:
- Copy, modify, distribute, sell, or lease any part of the App or its Content;
- Reverse engineer, decompile, or attempt to extract the source code of the App;
- Use the App for any commercial purpose without our prior written consent;
- Remove, obscure, or alter any proprietary notices or branding within the App;
- Use automated means (bots, scrapers, crawlers) to access or interact with the App.
User Conduct
When using the App you agree not to:
- Violate any applicable law or regulation;
- Post or transmit content that is defamatory, offensive, hateful, or otherwise objectionable;
- Impersonate any person or misrepresent your identity or affiliation;
- Attempt to gain unauthorised access to any part of the App or its infrastructure;
- Transmit viruses, malware, or any other malicious or harmful code;
- Interfere with or disrupt the App or servers or networks connected to it.
User-Generated Content
Where the App permits you to submit content, you retain ownership of that content. By submitting content, you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display that content for the purpose of operating and improving the App.
You represent that any content you submit does not infringe any third-party rights. We reserve the right to remove any content that we consider to breach these Terms or be otherwise objectionable, without notice.
Intellectual Property
All intellectual property rights in the App and its Content — including copyright, trademarks, database rights, and all other proprietary rights — are owned by or licensed to Sporting Allstars Limited. The Sporting Allstars name, logo, and all related marks are trademarks of Sporting Allstars Limited. You may not use them without our prior written consent.
Third-Party Services
The App integrates with third-party services including social login providers, Stripe (payment processing), and basic analytics tools. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of any third-party services.
Disclaimer of Warranties
The App and its Content are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.
Our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the App shall not exceed the greater of £100 or the total amount you have paid to us in the twelve months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. Your statutory consumer rights are not affected.
Indemnification
You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your breach of these Terms, or your violation of any third-party rights.
Changes to the App & These Terms
We may modify, suspend, or discontinue any part of the App at any time. We may update these Terms from time to time and will notify you of material changes via the App or by email. Your continued use of the App after notification constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the App without notice if you breach these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings. Outstanding payment obligations survive termination.
App Store Terms
These Terms are between you and Sporting Allstars Limited only, and not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide any maintenance or support for the App. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
Governing Law
These Terms are governed by the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, save that we reserve the right to bring proceedings in any jurisdiction where you reside or where a breach occurs.
